This page is specifically intended for California residents exercising their rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). If you are a California resident, you have the legal right to opt out of the sale or sharing of your personal information.

1. Your Right to Opt-Out Under California Law

Under CCPA § 1798.120 and CPRA § 1798.135, California residents have the right to direct any business that sells or shares personal information to stop doing so. This right applies regardless of whether you are a customer, a website visitor, or any other type of user.

You also have the right to be free from discrimination for exercising this right — we will not deny you services, charge different prices, or provide lower quality service because you opted out.

2. Definitions: What Counts as "Sale" or "Sharing"?

Under California law, "sale" includes disclosing personal information to third parties in exchange for monetary or other valuable consideration. "Sharing" under CPRA includes disclosing personal information for cross-context behavioral advertising, even without payment.

These definitions are broader than their common-language meanings and may include:

  • Transferring browsing data to advertising networks for targeted ad delivery
  • Passing user data to analytics platforms that aggregate and resell audience insights
  • Using third-party pixels (e.g., Meta Pixel, Google Ads) that receive behavioral data from your visit
  • Allowing data brokers or marketing platforms to receive identifiable device information

3. Our Current Data Practices

90 AI Engineering does not sell personal information in the traditional commercial sense. However, to maintain full compliance with CCPA/CPRA, we disclose that the following practices may constitute "sharing" under the broad CPRA definition:

  • Marketing Cookies and Pixels: We use Meta Pixel, Google Ads Conversion Tracking, and LinkedIn Insight Tag. These tools transmit certain behavioral data to third-party advertising platforms, which may use it to build audience profiles and deliver targeted advertising. This activity may constitute "sharing" under CPRA § 1798.140(ag)
  • Analytics Platforms: We share aggregated and IP-anonymized usage data with Google Analytics and Hotjar to improve website performance. While this data is largely anonymized, it may still qualify as personal information under CCPA in certain contexts
  • Business Development: In the future, if our business practices evolve to include data partnerships or lead generation activity involving personal information, this page will be updated accordingly

4. How to Opt Out

You have multiple methods to exercise your opt-out right:

Method 1 — Submit a Direct Opt-Out Request (Recommended)

Send an email to: hq@90ai.engineering

Subject line: "California CCPA — Do Not Sell or Share My Personal Information"

Include in the body of your email:

  • Your full name
  • Your email address used when interacting with our website
  • The statement: "I am a California resident and I request that 90 AI Engineering cease the sale or sharing of my personal information."

We will confirm receipt within 10 business days and complete your opt-out within 45 business days.

Method 2 — Cookie Preference Manager

To stop the sharing of data through cookies and tracking pixels:

  1. Return to our website homepage
  2. Click "Manage Preferences" on the cookie consent banner
  3. Deselect "Marketing / Advertising Cookies" and "Analytics / Performance Cookies"
  4. Click "Save My Preferences"

This prevents marketing pixels and analytics tools from receiving data from your current browser session. The preference is saved for 12 months.

Method 3 — Global Privacy Control (GPC)

If your browser sends a Global Privacy Control (GPC) signal — a universal opt-out mechanism recognized under CPRA — we will automatically honor it as a valid opt-out request for cookie-based sharing. GPC is supported by:

  • Firefox (via browser settings or the DuckDuckGo extension)
  • Brave (enabled by default)
  • The Privacy Badger browser extension

Method 4 — Platform-Level Opt-Outs

You may limit third-party ad targeting directly through platform settings:

  • Google: myaccount.google.com/ads — Manage Google ad personalization
  • Meta/Facebook/Instagram: facebook.com/ads/preferences — Manage your ad preferences
  • LinkedIn: LinkedIn Settings → Data Privacy → Advertising Data and Activity
  • Digital Advertising Alliance: optout.aboutads.info — Opt out of DAA member companies
  • Network Advertising Initiative: optout.networkadvertising.org

5. Scope and Duration of Opt-Out

Once your opt-out is confirmed:

  • Your opt-out remains in effect indefinitely unless you explicitly request reinstatement
  • We will add your identifier(s) to our internal opt-out list and suppress data sharing accordingly
  • Cookie-based opt-outs persist for 12 months on your current device and browser; you may need to re-exercise this right if you clear cookies or use a different device
  • Email-based opt-outs are device/browser-independent and apply to all identified records we hold

6. Verification and Identity Confirmation

We take privacy seriously and must verify the identity of opt-out requesters to prevent fraudulent requests. When you submit a request:

  • We will attempt to match the information you provide (name, email) against our records
  • For high-risk requests (e.g., data deletion combined with opt-out), we may request additional verification such as a copy of a government-issued ID (sensitive information will be redacted after verification)
  • We will never sell or use identity verification data for any purpose other than fulfilling your privacy rights request

7. Requests by Authorized Agents

A California consumer may designate an authorized agent to submit an opt-out request on their behalf. To do so, the agent must provide:

  • The California consumer's full name and email address
  • The agent's full name and contact information
  • Written authorization (e.g., a signed letter of authorization or Power of Attorney) granting the agent authority to act

We may contact the consumer directly to confirm the agent's authorization. Requests submitted without proper authorization will not be fulfilled.

8. Minor Privacy Protection

We do not sell or share the personal information of consumers we know to be under 16 years of age without affirmative authorization as required by CCPA § 1798.120(c).

For consumers aged 13–15, opt-in authorization must come from the minor themselves. For consumers under 13, opt-in authorization must come from a parent or guardian. If you believe we have collected data from a minor, contact hq@90ai.engineering immediately.

9. Your Additional CCPA Rights

In addition to opting out of sales and sharing, California residents have the following rights under CCPA/CPRA. Visit our Privacy Policy for full details:

  • Right to Know: Request disclosure of personal information we have collected, used, disclosed, or sold in the past 12 months
  • Right to Delete: Request deletion of personal information we hold, subject to legal exceptions
  • Right to Correct: Request correction of inaccurate personal information in our records
  • Right to Limit Sensitive Information: Limit our use of sensitive personal information to specified purposes
  • Right to Non-Discrimination: Exercise any of these rights without fear of retaliation, denial of service, or different pricing

10. Annual Metrics Disclosure

As required by CCPA § 1798.135, businesses processing significant volumes of consumer data must publish annual metrics. We commit to maintaining transparency reports upon request, detailing:

  • Total number of opt-out requests received and honored in the prior calendar year
  • Median response time for opt-out requests
  • Categories of personal information shared with third parties, if any
